Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the Daily Parent mobile apps, website, and related services (collectively, the "Services"), operated by ByDesign Development Inc. ("we," "us," or "our"), a corporation incorporated in Ontario, Canada.

By accessing the website, downloading, installing, or using any Daily Parent app, you confirm that you are at least 13 years of age and that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Services on behalf of a minor in your care, you represent that you have the authority to agree to these Terms on their behalf.

2. About Daily Parent

Daily Parent is a family of parenting and wellbeing products designed to support parents in their daily emotional wellbeing and parenting practice. Our Services may include mobile apps, websites, educational content, affirmations, reflections, app previews, product information, and related resources.

The Daily Parent app provides curated affirmations, reflections, and content filterable by parent type (including but not limited to: new parents, working parents, stay-at-home parents, single parents, special needs parents, co-parents, and blended family parents).

The Daily Parent app is available exclusively on the Apple App Store for iOS devices. No Android version is available at this time.

3. Website Use

You may use our website for lawful, personal, and informational purposes. You agree not to misuse the website, interfere with its security or operation, attempt unauthorized access, scrape or harvest content in a way that burdens the site, or use the website to transmit harmful code or unlawful material.

Our website may include product descriptions, app screenshots, guides, blog posts, waitlist links, contact options, links to the Apple App Store, and links to third-party websites. Website content is provided for general information and may change without notice.

We may use cookies and analytics technologies on the website as described in our Privacy Policy. By using the website, you acknowledge that website analytics and cookie practices are governed by that Privacy Policy and any cookie consent choices made available to you.

4. User Accounts

The current version of Daily Parent does not require you to create an account. Your preferences and settings are stored locally on your device.

Future versions of the App may introduce optional user accounts, including sign-in options via Apple ID or Google. If and when such features are introduced, additional terms may apply and you will be given the opportunity to review them before creating an account.

5. Email Communications

The current version of Daily Parent does not collect your email address. When user accounts are introduced in a future version of the App, the following will apply:

If you contact us through the website or by email, we may respond to the email address you provide. If we offer a newsletter, waitlist, or similar optional communication, we will describe what you are signing up for and provide any unsubscribe mechanism required by law.

Service Emails

We will send you transactional and service-related emails that are necessary to operate your account, including account confirmation, password reset links, and purchase receipts. These emails are not optional and will be sent regardless of your communication preferences, as they are required to deliver the service you have requested.

Re-engagement and Onboarding Emails

By creating a Daily Parent account, you acknowledge that an existing business relationship is established between you and ByDesign Development Inc. As part of that relationship, we may send you:

• An onboarding email series to help you get started with the App
• Re-engagement messages encouraging you to return to the App
• Notifications about new features, affirmations, or content updates

These communications are sent based on our existing relationship with you as a registered user of Daily Parent, consistent with Canada's Anti-Spam Legislation (CASL). We do not send unsolicited commercial email to people who have not created an account.

Opting Out

Every non-transactional email we send will include a clear and functional unsubscribe link. You may opt out of re-engagement and marketing emails at any time by clicking that link or by contacting us at privacy@dailyparentapp.com. We will honor all unsubscribe requests within 10 business days. Opting out of marketing emails will not affect your access to the App or your ability to receive transactional messages.

6. Subscriptions and In-App Purchases

6.1 Subscription Offerings

Daily Parent may offer premium features through auto-renewing subscriptions and/or one-time in-app purchases (including consumables) available through the Apple App Store. Current offerings, pricing, and subscription tiers are displayed within the App and on the App Store listing.

6.3 How to Cancel

You may cancel your subscription at any time through your Apple ID account settings. Cancellation prevents future charges but does not provide a refund for the current billing period. To cancel:

1. Open the Settings app on your iPhone
2. Tap your name, then tap Subscriptions
3. Select Daily Parent and tap Cancel Subscription

You will retain access to premium features until the end of your current paid period.

6.4 Refunds

All purchases are processed by Apple. We do not control Apple's refund decisions. If you believe you are entitled to a refund, you must request it directly from Apple:

Refund requests are subject to Apple's refund policies and are granted at Apple's sole discretion.

6.5 Subscription Management via RevenueCat

We use RevenueCat to manage subscription entitlements. RevenueCat verifies your purchase receipt with Apple to determine whether you have an active subscription. See our Privacy Policy for more information on how RevenueCat processes your data.

7. Licence to Use the Services

Subject to your compliance with these Terms, ByDesign Development Inc. grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on any iOS device that you own or control, solely for your personal, non-commercial purposes.

We also grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the website for personal, non-commercial, informational purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App or its content
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App for any unlawful or unauthorized purpose
• Remove or alter any proprietary notices or labels on the App
• Use the App in any manner that could damage, disable, or impair the App or interfere with any other party's use of the App

8. Content and Intellectual Property

All content within Daily Parent - including but not limited to affirmations, text, guides, website copy, graphics, logos, icons, images, audio clips, app screenshots, and the overall design and compilation of the Services - is the property of ByDesign Development Inc. or its licensors and is protected by Canadian and international intellectual property laws.

The "Daily Parent" name and logo are trademarks of ByDesign Development Inc. You may not use our trademarks without prior written permission.

The App content is provided for personal use only. You may not reproduce, distribute, publish, or create derivative works from any App content without our express written consent.

10. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Services will be uninterrupted, error-free, or free of viruses or other harmful components
• The content in the Services is accurate, complete, current, or suitable for your needs
• Any defects in the Services will be corrected

Some jurisdictions do not allow the exclusion of implied warranties; in such cases, our liability is limited to the minimum extent permitted by applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ByDesign Development Inc. and its directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the Services
• Any content obtained through the Services
• Unauthorized access to or alteration of your data
• Any interruption or cessation of the App

In no event shall our total liability to you for all claims arising from your use of the Services exceed the greater of: (a) the amount you paid us (if any) in the 12 months preceding the claim, or (b) CAD $50.00.

Some jurisdictions do not allow certain limitations of liability; in such cases, these limitations apply to the fullest extent permitted by law.

12. Third-Party Services and Links

The Services integrate with or link to third-party services including Apple App Store, PostHog, RevenueCat, and Superwall. Your use of those services is subject to their respective terms of service and privacy policies. ByDesign Development Inc. is not responsible for the practices of any third-party service providers.

The Services may contain links to third-party websites, app stores, tools, or resources. These links are provided for convenience only. We do not endorse and are not responsible for any content, products, or services available from third-party sources.

13. Apple App Store Requirements

These Terms are between you and ByDesign Development Inc. only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.

In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, Apple's terms govern with respect to your use of the App Store.

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and that Apple has the right to enforce these Terms against you as a third-party beneficiary.

14. Modifications to the Services and Terms

Changes to the Services

We reserve the right to modify, suspend, or discontinue the Services or any feature at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of these Terms. If the changes are significant, we will provide additional notice (such as through the App or App Store release notes). Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically. The current version is always available at dailyparentapp.com/terms.

15. Termination

We reserve the right to terminate or suspend your access to the Services at any time, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your licence to use the Services will immediately cease.

You may stop using the App at any time by deleting it from your device. If you have an active subscription, you must also cancel it through your Apple ID settings (see Section 6.3) to avoid further charges.

Provisions of these Terms that by their nature should survive termination - including intellectual property rights, disclaimer of warranties, limitation of liability, and governing law - shall survive termination.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. If you are a consumer resident of the European Union, you may also have the right to bring proceedings in your country of residence.

Before initiating any formal dispute, we encourage you to contact us at support@dailyparentapp.com so we can attempt to resolve the matter informally.

17. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ByDesign Development Inc. regarding your use of the Services and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing to be effective.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Language

These Terms are written in English. To the extent permitted by law, the English version shall prevail in the event of any inconsistency with a translated version.
